Terms of Service

These terms are an agreement between you and AsiaPoker ("we", "us"). They cover your use of the AsiaPoker game on the web and in our mobile apps (together, the "Game"), and of this website. By creating an account or playing, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Game.

1. Who can play

• You must be 18 or older, or the age of majority where you live if that's higher.
• You must not use the Game where doing so is against the law where you are.
• You're responsible for your account and for everything that happens on it. Keep your sign-in details private.

2. Your account

• When you first open the Game we create an account for you. Signing in with Google or Apple links it to that sign-in, so you can use it on other devices.
• An account that isn't linked to a sign-in exists only on the device or browser where you created it. If you clear that device's data or lose the device, you may lose the account and its chips for good.
• Your display name must not be offensive or misleading, impersonate anyone, or contain anyone's personal information. We may change a name that breaks this rule.
• You may hold one account per person, unless we agree otherwise.

3. Chips and purchases

• Chips are virtual items with no monetary value. They're a limited, personal, revocable licence to use a feature of the Game. They're not your property, and they can't be withdrawn, cashed out, redeemed, exchanged for money or anything of value, sold, or transferred to another player or account.
• We give free chips, including a welcome balance and an automatic refill. We may change how much and how often.
• You may be able to buy chips or a subscription through the Apple App Store or Google Play. Purchases are processed by the store under its terms, including its refund policy. Apart from those policies and your rights under consumer law, all purchases are final.
• We may adjust balances to correct errors, bugs or abuse.
• Subscriptions renew automatically until you cancel them in your store account settings.

4. Fair play

You agree not to:

• cheat, collude with other players, share hole-card information during a hand, or deliberately lose chips to another account;
• use bots, scripts or automation to play, or any software that gives you an unfair advantage;
• exploit bugs (please report them to us instead), or interfere with, overload, reverse-engineer or attack the Game or its servers;
• buy, sell or trade chips or accounts, or offer to, including outside the Game;
• harass, threaten or abuse other players, or use display names or private-table names that do any of these things;
• use the Game for any unlawful purpose, including any form of real-money gambling or betting on the outcome of games.

Computer-controlled players may take seats at public tables so games can start quickly. They play by the same rules as everyone else and cannot see anyone's hidden cards.

5. Private tables

If you create a private table, you control who gets the invite code and you're responsible for the table's name. You must not use private tables to organise real-money games or settle real-money debts based on results in the Game.

6. Suspension and termination

If you break these terms, we may warn you, remove chips gained by breaking them, or suspend or close your account. Where reasonable, we'll tell you why. You can stop using the Game and delete your account at any time. When an account is closed, its chips are forfeited.

7. Changes to the Game

The Game is under active development. We may add, change or remove features, rules, tables, stakes and chip amounts, or stop offering the Game, with notice where reasonable. If we stop offering the Game permanently, we'll give at least 30 days' notice in the Game.

8. Our content

The Game, its software, design, artwork and the AsiaPoker name belong to us or our licensors. You may use the Game only for your own personal, non-commercial entertainment.

9. Our responsibility to you

Nothing in these terms limits any rights you have under the Australian Consumer Law or other consumer laws that can't be excluded. Subject to those rights:

• The Game is provided "as is". We don't promise that it will always be available, error-free, or that your progress or chips will never be lost.
• We aren't responsible for losses that weren't reasonably foreseeable, or for losing virtual items that have no monetary value.
• To the extent the law allows, our total liability to you is limited to the amount you paid us in the 12 months before the claim. Where we can't exclude a guarantee, our liability is limited to supplying the service again or paying for it to be supplied again.

10. Play responsibly

Playing or winning at AsiaPoker doesn't mean you'll succeed at real-money gambling. If gambling is affecting you or someone close to you, free and confidential help is available. In Australia, call Gambling Help Online on 1800 858 858 or visit gamblinghelponline.org.au.

11. Consumer law

If you're a consumer, nothing in these terms takes away the protection of the mandatory consumer laws of the country where you live, including the Australian Consumer Law if you live in Australia.

12. Changes to these terms

We may update these terms. We'll post the new version here with a new effective date, and tell you in the Game if the changes are significant. If you keep playing after the changes take effect, you accept them. If any part of these terms can't be enforced, the rest still applies.
